Terms & Conditions

Last updated: May 28, 2026

These Terms & Conditions (“Terms”) govern your use of helixpacks.com (the “Site”) and any quotes, orders, samples, or services provided by Helix Packs Inc (“Helix Packs,” “we,” “us,” or “our”). By using the Site, requesting a quote, or placing an order, you agree to these Terms. If you do not agree, please do not use the Site or our services.

1. About our services

Helix Packs provides custom packaging — including flexible packaging, cartons and product boxes, rigid and gift boxes, mailers and bags, and labels and print. Our products are made to order based on your specifications.

The Site lets you browse formats, materials, and options, request quotes, order sample packs, and apply to our affiliate program. The Site is not an online store with instant checkout. Orders are confirmed directly with our team.

2. Who can use our services

Our services are intended for businesses and for individuals who are at least 18 years old and able to enter into a binding contract. By using our services, you confirm you meet these requirements and that any information you provide is accurate.

3. Quotes and orders

  • Quotes are estimates. A quote reflects pricing based on the specifications, quantity, and materials discussed at that time. Quotes are valid for the period stated, or 30 days if no period is given, and may change if specifications change or if material or production costs change.
  • An order is confirmed only when we accept it in writing and, where applicable, you have approved the final proof and paid any required deposit.
  • Minimum order quantities (MOQs)may apply and vary by product. We’ll confirm the MOQ for your project before production.
  • We may decline or cancel any order — for example, due to pricing errors, suspected fraud, or capacity constraints. If we cancel before production, we’ll refund any amounts you’ve paid for that order.

4. Custom products and cancellations

Because our products are custom-made to your specifications:

  • Once production begins, orders generally cannot be cancelled, changed, or returned, except as required by law or as described in Section 9 (Defects).
  • If you need to change or cancel an order, contact us as soon as possible. Whether changes are possible depends on the stage of production, and you may be responsible for costs already incurred (such as materials, tooling, or work completed).

5. Sample packs

We offer sample packs so you can review materials and finishes before committing to production. Samples are representative of our materials and quality but may differ from your final custom product in color, size, or finish. Sample availability and any associated fees will be confirmed when you order.

6. Pricing and payment

  • Prices are quoted in U.S. dollars unless stated otherwise and exclude taxes, duties, and shipping unless noted.
  • We may require a deposit before starting production, with the balance due as stated on your quote or invoice.
  • Payment terms, accepted methods, and due dates are set out on your quote or invoice. Late payments may delay production or delivery.

7. Artwork, proofs, and your responsibilities

  • Proof approval. Before production, we provide a proof for your approval. You are responsible for reviewing it carefully — including spelling, layout, colors, dimensions, and barcodes. Once you approve a proof, production proceeds based on what you approved, and we are not responsible for errors you did not catch.
  • Color variation. Printed colors may vary slightly from on-screen previews and between production runs due to the nature of printing and materials. We use Pantone-calibrated printing and digital proofs to keep results consistent.
  • Your content. You are responsible for any logos, images, text, designs, or other materials you provide. By submitting them, you confirm that you own them or have the rights to use them, and that they do not infringe anyone’s intellectual property, violate any law, or contain unlawful or harmful content. You agree to indemnify us for any claim arising from materials you provide.

8. Intellectual property

  • Our content. The Site and its content — including text, graphics, logos, images, and design — are owned by or licensed to Helix Packs and protected by intellectual property laws. You may not copy, reproduce, or use them without our written permission.
  • Your content. You keep ownership of the artwork and brand assets you provide. You grant us a limited license to use them solely to produce your order and provide our services.
  • Tooling and dies. Unless agreed otherwise in writing, any tooling, dies, plates, or production setups we create remain our property, even where setup costs are included in your order.

9. Shipping, delivery, and defects

  • Lead times are estimates (for example, from 25 business days) and start once your order and proof are confirmed. We are not liable for delays outside our reasonable control, such as carrier delays, supply shortages, or events beyond our control.
  • Risk of loss passes to you when the order is handed to the carrier, unless we agree otherwise.
  • Inspect your order. Please inspect your order promptly on delivery. To report a problem, contact us within 10 business days of delivery (or as otherwise stated on your invoice) with details and photos.
  • Defects. Every order is inspected before shipping. If a production defect is our fault, we will reprint or replace the affected items, or provide another remedy at our discretion. This is your exclusive remedy for defective products. Minor variations consistent with industry standards (including reasonable color and quantity variation) are not considered defects.

10. Affiliate program

If you apply to or join our affiliate program, additional terms may apply and will be provided to you. We may approve or decline applications at our discretion. Commission rates, payment terms, and program rules are set out in the affiliate terms and may be updated from time to time.

11. Acceptable use of the Site

  • Attempt to gain unauthorized access to the Site or its systems
  • Introduce malware or interfere with the Site’s operation
  • Copy, scrape, or harvest content or data without permission
  • Misrepresent your identity or affiliation

12. Third-party links

The Site may contain links to third-party websites or services we don’t control. We are not responsible for their content, policies, or practices. Accessing them is at your own risk.

13. Disclaimers

The Site and our services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties not expressly stated in these Terms, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

14. Limitation of liability

To the fullest extent permitted by law, Helix Packs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from or related to the Site, our products, or these Terms. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Nothing in these Terms limits liability that cannot be limited under applicable law.

15. Indemnification

You agree to indemnify and hold harmless Helix Packs and its officers, employees, and agents from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Site, your breach of these Terms, or any materials or content you provide to us.

16. Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute relating to these Terms or our services will be subject to the exclusive jurisdiction of the state and federal courts located in New York County, New York, and you consent to that jurisdiction.

17. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date above shows when. Changes take effect when posted. Your continued use of the Site or our services after changes are posted means you accept the updated Terms.

18. General

  • Severability. If any provision is found unenforceable, the rest of these Terms remain in effect.
  • No waiver. Our failure to enforce a provision is not a waiver of it.
  • Entire agreement. These Terms, together with any quote, order confirmation, or program terms we provide, make up the entire agreement between you and Helix Packs regarding the Site and our services.
  • Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
